How the Social Security Disability Claims Process Works in Simpsonville, SC

The Social Security Administration (SSA) has a process in place for all Social Security disability claims. It has field offices and state agencies to assist those who want to file disability claims in cities and towns nationwide. A person can submit a Social Security disability claim in person, over the phone, via mail, or by completing an online application.

SSA can deny a Social Security disability claim for many reasons, such as:

• There is a lack of documentation to verify that an individual is dealing with a disability and/or how a disability prevents this individual from working.
• An individual’s Social Security claim for a disability was previously denied.
• An individual ignores SSA’s requests for additional information regarding their claim.
• The recommendations of a doctor or healthcare provider were not followed.
• An individual is earning too much money.

A South Carolina social security disability lawyer understands the challenges that come with disability claims. The attorney can review an individual’s disability claim in detail. Then, the lawyer can help this individual file an appeal.

How to Appeal a Social Security Disability Claim Denial in Simpsonville, SC

There are four levels of appeal for Social Security claim denials. If you complete all of these stages and are still denied benefits, you can take your case to federal court for review. The process is as follows:

1. Initial Determination

The initial determination phase is the first step in any appeal, as it refers to the SSA’s initial decision on your eligibility, payment amount, and whether or not you were overpaid. The first “initial determination” is likely the decision you’re seeking to appeal, but all of the SSA’s written decisions are called “initial determinations” – regardless of when in the process they happen.

2. Reconsideration

An individual can ask SSA to reconsider the original request if the denial occurred for medical reasons. This allows SSA to take a second look at all of the evidence relating to an individual’s initial request, along with any new information this person wants to provide. Or, a person can submit a reconsideration request due to nonmedical reasons like overpayments or a denial of income.

2. Hearing by an Administrative Law Judge (ALJ)

If a Social Security disability claim is denied during reconsideration, a person can ask an ALJ who was not a part of the initial decision-making process to review their claim. At this point, an individual can present evidence to an ALJ to show why their claim should be approved. The ALJ then decides if the claim is accepted or rejected.

3. Review by Social Security’s Appeals Council

An individual can request a hearing with the Social Security’s Appeals Council following an ALJ’s decision. The council will review the ALJ’s decision during the hearing and decide on its validity. If the council finds no Social Security laws or regulations were violated, it can deny or deny the request.

4. Federal Court Review

An individual can request a federal court review their Social Security disability claim denial. To do so, an individual can contact SSA to request the form online or over the phone. This individual can complete the necessary paperwork, submit it, and await the response to their federal court review.
